As of November 6th 2025 the Supreme Court of the United States has upheld the Trump Administration's executive order DEFENDING WOMEN FROM GENDER IDEOLOGY EXTREMISM AND RESTORING BIOLOGICAL TRUTH TO THE FEDERAL GOVERNMENT which prevents trans, non-binary and intersex individuals from having passports issued that reflect their correct gender marker/a gender marker different than the one listed on their birth certificate. This also prevents people from updating their gender with the Social Security Administration.
This does not impact state laws which allow people to update their legal names and gender marker on their state ID, driver's license or birth certificate where applicable.
As of June 2025 a temporary injunction has been issued that allows trans people to update or get a new passport with their correct gender marker 🎉

Update as of Jan 2025 per Trump executive order you can no longer update or change the gender marker listed on your passport or with the Social Security Administration.
Passports:
If you're eligible for a passport in the US you do not need to provide any documentation to use your correct gender marker or update your gender marker. If you're currently in a state that does not allow you to update your driver's license a passport can be used instead of a driver's license + SS card or birth certificate for employment verification.
